Fortress “Sev berd” illegally alienated to an individual: disclosure of the Police

In the course of preparation of materials, undertaken on the basis of information received by the Department for Combating Corruption and Economic offences of the General Department of Criminal Police, factual data were obtained that by the decision of the Government dated June 6, 1995, "Sev Berd" fortress in Gyumri was transferred to the balance of the Ministry of Defense, which, in accordance with Article 13 of the RA Law “On preservation and use of the immovable historical and cultural monuments and historic environment”, by the decision of the Government dated September 9, 2004, was included in the state list of immovable historical and cultural monuments of Shirak marz, and in April 2005 it was handed over to the Ministry of Defense with a certificate of ownership issued by Gyumri territorial subdivision of the State Committee for Real Estate Cadastre under the RA Government.
Subsequently, high-ranking officials of the Ministry of Defense and other competent officials, out of other personal interests, used their powers against the interests of the service, in violation of the requirements of subparagraph "B" of Article 2 of the RA Law "On Immovable Historical and Cultural Monuments Considered State Property of the Republic of Armenia and not subject to alienation”, illegally organized the process of alienation of “Sev Berd” fortress-monument of state significance, owned by the Ministry of Defense of the Republic of Armenia, to an individual, within which, formally referring to the Government Decision dated January 25, 2005 on permission to alienate lands transferred to the Ministry of Defense, which are not related to the alienation of this monument, a purchase and sale agreement was signed between an authorized person of the Ministry of Defense and an individual who is the buyer, which was certified by a notary of "Kentron" notarial district on May 11, 2005 in violation of the requirements of Article 52 of the RA Law “On Notaries”.
Then, the competent officials of the territorial subdivision of the State Committee for Real Estate Cadastre under the RA Government, also out of other personal interests, abused their official powers, in violation of the requirements of Article 30 of the RA Law "On State Registration of Property Rights", on May 19, 2005 registered "Sev Berd" fortress in the name the specified individual, as a result of which the State, represented by the legitimate interests of the RA Ministry of Defense, suffered significant damage.
In connection with this fact a criminal case has been initiated in the General Department of Criminal Police, which was sent to the Investigative Committee.
